Terms and Conditions

1. Eligibility

You must be at least 18 years of age, of sound mind, and legally eligible to marry under the laws of Sri Lanka to register for and use Pathuma. By using the Service you represent and warrant that you meet these requirements, that you are seeking a genuine matrimonial relationship for yourself (or, where you register on behalf of a family member, that you do so with that person’s knowledge and consent), and that you are not barred from using the Service under any applicable law or by a previous suspension or ban. We may refuse, suspend, or terminate access for anyone at our discretion.

2. Your Account

You register using your mobile number, a valid email address, and a password. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. You agree to provide true, accurate, current, and complete information and to keep it up to date. A valid email address is required so that we can send you service and transactional notifications about your account, profile, Interests, and payments — these are operational messages, not marketing. One person may hold only one account. You must notify us immediately of any unauthorised use of your account. We are not liable for any loss arising from your failure to safeguard your account.

3. The Service — Introductions Only

Pathuma is an online platform that lets members create profiles, search other members’ profiles, and express interest in one another. Pathuma is solely a venue for introductions. We are not a marriage broker, matchmaker, counsellor, investigator, or agent, and we are not a party to any communication, relationship, engagement, or marriage between members. We do not guarantee that you will find a match, a partner, or a spouse, or that any profile, match, or interaction will meet your expectations.

4. Identity & Profile Verification — Limitations

We carry out a manual, best-effort review of profiles before they appear in search, to reduce obviously fake or inappropriate content. This review is NOT a background check. We do not verify the identity, age, marital status, criminal record, financial status, health, character, or intentions of any member, and we do not independently confirm the accuracy of the information members provide. You are solely responsible for your own due diligence and personal safety. Exercise caution, verify information independently, and meet other members only in safe, public places. Any decision to communicate, meet, or enter into a relationship or marriage with another member is made entirely at your own risk.

5. Plans, Interests & Payments

Registration is free and includes the Free Starter plan, which grants a limited number of Interests per week with no expiry. You may purchase the Standard or Pro plan for a higher weekly Interest allowance and a profile boost; paid plans are valid for a fixed period (currently 30 days) from activation and do not auto-renew. Sending an Interest consumes one unit of your weekly allowance whether or not the recipient accepts it. When a recipient accepts an Interest, both members’ contact details become visible to each other. Prices are shown in Sri Lankan Rupees (LKR) and are inclusive of applicable taxes unless stated otherwise. Payment is made by bank transfer, verified manually by our team; card and online payments are not available at this time. We may change plans, allowances, and pricing at any time; changes do not affect a plan that is already active. All purchases are subject to our Refund Policy.

6. Acceptable Use & Member Conduct

You agree that you will:

• Provide only truthful information and use your own genuine photographs;
• Use the Service for lawful, personal, matrimonial purposes only;
• Treat other members with respect, and not harass, threaten, defame, stalk, or abuse anyone;
• Not solicit money, donations, or financial or commercial favours from other members, and not use the Service for dating-only, escort, commercial, fraudulent, or immoral purposes;
• Not impersonate any person, create fake or duplicate profiles, or misrepresent your age, marital status, or identity;
• Not post or share content that is unlawful, obscene, defamatory, hateful, or infringing, or that contains another person’s private information without their consent;
• Not collect, scrape, copy, store, or redistribute other members’ information or photographs;
• Not introduce malware or attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.

Breach of this section may result in immediate suspension or termination without refund and, where appropriate, referral to law-enforcement authorities.

7. Content You Provide

You retain ownership of the information and photographs you submit. By submitting content, you grant Pathuma a non-exclusive, royalty-free licence to host, store, process, display, and share that content as necessary to operate the Service — including displaying your profile to other members and revealing your contact details to a member whose Interest you accept. If you keep your profile photo public, this also includes showing a limited preview of your profile (your photo, display name, age, profession, and city) in public areas of the Service, such as the “Featured Profiles” section on our homepage — you can make your photos private at any time in settings to prevent this. You represent that you have the right to share all content you submit and that it does not infringe any third party’s rights.

8. Privacy & Contact Details

Your use of the Service is also governed by our Privacy Policy. Sensitive personal information is encrypted at rest, and your contact details are disclosed to another member only after you accept that member’s Interest. You may mark your photographs as private, in which case they are shown only to members you have connected with. You are responsible for the information you choose to share with other members directly.

9. Intellectual Property

The Pathuma name, logo, design, text, and software are owned by NYRION (PVT) LTD and protected by law. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service, except for the content you yourself submit.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that profiles or information are accurate or genuine, or that your use of the Service will result in a match, relationship, or marriage.

11. Limitation of Liability

To the fullest extent permitted by law, NYRION (PVT) LTD and its directors, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, reputation, opportunity, or goodwill, arising out of or relating to your use of (or inability to use) the Service, the conduct of any member, any meeting or relationship between members, or any fraud, misrepresentation, injury, or harm caused by another member, whether online or offline. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service shall not exceed the total amount you actually paid to us in the three (3) months immediately preceding the event giving rise to the claim.

12. Indemnity

You agree to indemnify and hold harmless NYRION (PVT) LTD and its personnel from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, your interactions with other members, or your breach of these Terms or of any law or third-party right.

13. Suspension & Termination

We may, at our sole discretion and without prior notice, suspend, restrict, or terminate your account or remove any content if we believe you have breached these Terms, provided false information, created a fake or duplicate profile, engaged in fraud or harmful conduct, or where required by law. You may stop using the Service and delete your account at any time from the Settings page. Termination for breach does not entitle you to any refund. Provisions that by their nature should survive termination — including conduct, disclaimers, limitation of liability, indemnity, and governing law — will survive.

14. Third-Party Services

The Service relies on third parties such as our cloud infrastructure provider. We are not responsible for the acts, omissions, availability, or policies of those third parties.

15. Changes to the Service & Terms

We may modify, suspend, or discontinue any part of the Service, and may update these Terms from time to time. Updated Terms take effect when posted on this page with a revised "last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict-of-law principles. You agree that the courts of Colombo, Sri Lanka shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Before commencing any formal proceedings, you agree to first contact us in good faith to seek an amicable resolution.

17. General

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right is not a waiver of that right. You may not assign your rights under these Terms; we may assign ours to an affiliate or successor. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.
